1. Acceptance of Terms

By installing and using WAPES ("the Extension"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not install or use the Extension.

1.1 Service Owner

WAPES is operated by Jesus Alejandro Rojas Ponce, an independent individual (Sole Trader) based in the Republic of Peru. For any legal inquiries please contact wapes.crm@gmail.com.

1.2 No Affiliation with WhatsApp

WAPES is not affiliated with, sponsored by, endorsed by, or in any way associated with WhatsApp Inc., Meta Platforms Inc., or any of their subsidiaries. The names "WhatsApp" and "WhatsApp Business" are registered trademarks of their respective owners. WAPES is an independent productivity tool that operates through the public interface of WhatsApp Web.

2. Description of Service

WAPES is a Chrome browser extension that provides tools for managing communication and contacts efficiently through WhatsApp Web. The Extension operates entirely within your browser and does not collect or transmit your data to external servers.

3. User Responsibilities

By using WAPES, you agree to:

  • Comply with WhatsApp's Terms of Service and acceptable use policies
  • Only send messages to contacts who have consented to receive communications from you
  • Not use the Extension for unsolicited messaging, harassment, or any illegal activities
  • Not use the Extension to send malicious content, phishing attempts, or malware
  • Comply with all applicable laws and regulations, including electronic messaging laws (GDPR, ePrivacy Directive, TCPA, etc.)
  • Take responsibility for all messages sent using the Extension

4. WhatsApp Terms Compliance

Important Notice

WhatsApp has its own Terms of Service that govern the use of their platform. Using third-party tools like WAPES requires responsible use to avoid violating WhatsApp's Terms of Service, which could result in:

  • Temporary or permanent suspension of your WhatsApp account
  • Loss of access to WhatsApp services
  • Other penalties imposed by WhatsApp

You acknowledge these risks and agree that WAPES is not responsible for any actions taken by WhatsApp against your account.

5. Disclaimer of Warranties

THE EXTENSION IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE EXTENSION WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WAPES AND ITS DEVELOPERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits or revenue
  • Loss of data
  • WhatsApp account suspension or termination
  • Damage to reputation
  • Business interruption

7. Indemnification

You agree to indemnify and hold harmless WAPES and its developers from any claims, damages, losses, liabilities, and expenses (including attorney fees) arising from your use of the Extension or violation of these Terms.

8. Modifications to the Extension

We reserve the right to modify, suspend, or discontinue the Extension at any time without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation.

9. Changes to Terms

We may update these Terms from time to time. Continued use of the Extension after changes constitutes acceptance of the new Terms. We encourage you to review these Terms periodically.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Peru. Any disputes shall be submitted to the exclusive jurisdiction of the competent courts of Lima, Peru.

11. Billing & Subscriptions

WAPES Pro operates on a monthly subscription model managed through Paddle:

  • A charge of $16.99 USD is billed monthly through the Paddle payment gateway.
  • The subscription renews automatically at the end of each monthly period until cancelled.
  • You will receive a payment receipt by email after each successful charge.
  • You can update or remove your payment method through the Paddle customer portal.
  • WAPES uses Paddle as Merchant of Record (MoR), meaning all payments, taxes, and invoicing are managed by Paddle (paddle.com) under their regulation.

12. Refund & Cancellation Policy

As WAPES Pro is a digital software product with immediate access, the following policy applies:

  • We offer a full refund within the first 14 days of your initial purchase if the service does not work as described. To request one, contact wapes.crm@gmail.com.
  • You may cancel your subscription at any time through the Paddle customer portal. Cancellation stops future renewals; you retain access until the end of the current paid period.
  • Refunds are not issued for subscription periods that have already been renewed and used.
  • In cases of duplicate charges or billing errors attributable to WAPES, a refund will be processed within 5 business days.
  • To request a refund, email wapes.crm@gmail.com with your purchase email address and reason.
